These Terms & Conditions apply to the use of kemasuthra.com and to photography, videography, social media management, digital marketing and related creative services supplied by Kemasuthra in Sri Lanka.

Service agreement

Every project is governed by the accepted quotation, project brief, written messages and these terms. The quotation defines the agreed deliverables, schedule, location, price, revisions and any client-supplied requirements. If a quotation contains a different term, the quotation takes priority for that project.

Booking and payment

• A booking is confirmed only after the agreed advance payment is received.
• The balance and payment dates are stated in the quotation or invoice.
• Work may be paused and delivery withheld while an overdue amount remains unpaid.
• Online payment confirmation may be provided by PayHere or the relevant payment provider.

Client responsibilities

The client must provide accurate information, timely approvals, safe access to locations and any required permissions. Unless the quotation states otherwise, the client is responsible for preparing rooms and spaces and arranging models, releases, food, drinks, props, styling, permits and other project inputs.

Scheduling, weather and delays

Shoot schedules depend on access, property readiness, weather and safe operating conditions. Drone coverage is subject to weather, flight restrictions and local regulations. Client delays, late feedback or missing materials may extend delivery dates.

Delivery and revisions

Delivery format, timing and included revision rounds are stated in the quotation. Revisions must relate to the approved brief. New concepts, reshoots, extra deliverables and changes outside the original scope may be quoted separately.

Copyright and usage rights

• Unless otherwise agreed in writing, Kemasuthra retains copyright in the work.
• After full payment, the client receives non-exclusive rights to use the final edited deliverables for the purposes agreed in the quotation, including relevant websites, social media, booking platforms and marketing.
• Paid advertising, resale, licensing or transfer to third parties is permitted only where included in the quotation or agreed in writing.
• Kemasuthra may display final work in its portfolio, website, social channels and promotional materials unless confidentiality or exclusivity has been agreed in writing.
• RAW photos, unedited footage, project files and source files are not included unless expressly stated in the quotation.

Cancellations and refunds

Cancellations, rescheduling and refunds are handled under our Refund & Cancellation Policy and any specific written project terms.

Liability

Kemasuthra will provide services with reasonable care and skill. To the extent permitted by law, our total liability relating to a project will not exceed the amount paid for the affected service. We are not responsible for indirect loss, lost bookings, lost profit, platform decisions or delays caused by events outside our reasonable control.

Website use

You may browse this website for lawful purposes. You may not copy, misuse, reproduce or commercially exploit site content without permission, attempt unauthorised access, or interfere with the website’s operation.

Changes and governing law

We may update these terms from time to time. The version published on this page applies from its stated update date. These terms are governed by the laws of Sri Lanka.
